Experience includes dispute resolution through arbitration, mediation, and litigation involving construction disputes, claims and other issues arising out of private and public construction projects including office buildings, apartment houses, co-ops, and condominiums; subway and railroad transit systems; sewage treatment and water pollution control plants; prisons; courthouses; large commercial structures such as convention enters, stadiums and airports; restoration work; hospitals; schools and colleges; design and construction failures in large geothermal and cogeneration projects; utility work and utility interference work; sewer and water main replacement; failures resulting in water and moisture intrusion causing mold; property damage claims; and interior design and construction. Evaluated and provided opinions of likelihood of success of claims and defenses as to both liability and damages; worked with office team, other counsel, and construction industry and technical experts on evidence/proof of claims.
Past representation includes virtually all parties to the construction process, including: owners, construction managers, prime contractors, sub-contractors, bonding companies, design professionals, material suppliers, and manufacturers.
Some of the issues resolved include: payment disputes; contract interpretation; design and scope changes; liability for defective construction; applicability of laws, rules, and regulations; incomplete and faulty design; liability for and calculation of delay damages; liability for and calculation of property damage claims; and extra and disputed work claims.
